Federal Higher court sitting in Dutse, Jigawa state capital on Thursday nullified the primary election of Muhammad Haruna Idris of the All Progressive Congress (APC).
The primary election was for the seat of the state house of Assembly member representing Kazaure Constituency in Jigawa North west Senatorial zone.
Delivering judgement, the presiding judge, Justice Hassan Dikko said based on the school certificates he presented, the court has satisfied that Muhammad Haruna has no requirements to contest the primary election.
“Also the court is satisfied that, some of the delegates were disenfranchised during the primary election and their votes belonged to other candidate, Barrister Bala Hamza Gada”, the Judge added.
“Therefore, the court has nullified the election of Muhammad Haruna Idris and declared the other contestant, Barrister Bala Hamza Gada as the true winner of the primary election”.
In his reaction to the judgement, counsel to the complainant, Barrister Ibrahim Sa’ad expressed his satisfaction on the outcome of the judgement and described it as victory to the rule of law and democracy.
He said their next line of action is to notify INEC and APC being the party in the suite and ask them to abide by the court ruling, and include the name of Barrister Bala Hamza on the ballot paper.
Also Barrister Bala Hamza who is the incumbent member representing Kazaure constituency, said the judgement was a victory for the rule of law and appealed to Haruna Idris to join hands with him for the victory of APC at all levels.
