A High Court of the Federal Capital Territory, on Thursday, struck out a suit seeking to compel the Attorney General of the Federation (AGF) and Inspector General of Police (IGP) to institute criminal charges against the suspended DCP Abba Kyari.
It would be recalled that the court on 4th of November, 2021 granted the applicant, Patrick Eholor, leave to file the action against the AGF and IGP.
Recall further that the matter was further adjourned to 22nd of November, 2021 for hearing.
However, the plaintiff failed to file the substantive suit nor serve the order of court on the respondent.
On the 22nd of November, 2021, the applicant was not represented.
Akinola Oladimeji, counsel from the office of Kayode Ajulo & Co. Castle of Law, who appeared for the 3rd defendant (DCP Abba Kyari ) informed the court of the indolent attitude of the applicant.
He then applied to the court to strike out the order.
The court interjected and noted that the applicant should be obliged further adjournment and the matter was further adjourned to today.
When the matter came up before the court on Thursday, the presiding judge, Hon. Justice S.B Belgore, having taken judicial notice of the indolent attitude of the applicant, in addition to the notice of discontinuance filed by the applicant, struck out the matter.
