A court of Appeal kano division, presided by Hon. Justice Habeeb Abiru JCA has on Monday affirmed the judgement of High Court of Justice Jigawa State where one Mummuni Tukur (Appellant) was convicted for the offences of rape and armed robbery.
A statement by the Public Relations Officer Jigawa State Ministry of Justice, Zainab Baba Santali said the judgement of the Jigawa High Court was delivered on 8th April 2019, by Hon. Justice Umar Maigari Sadiq (now Chief Judge of Jigawa State).
During the trial, the appellant was charged under sections 298(b) and 283 of the Penal Code Laws of Jigawa State, 2012 for the offence of rape and armed robbery, and at the end of the trial, the appellant was found guilty of the offences and was sentenced to 21 years imprisonment.
The facts of the case were that, Mummuni Tukur (Appellant) had waylaid a woman (name withheld) where he robbed and raped her at a bush called Shuga Bush in Kirkasamma Local Government area of Jigawa State.
The appellant was later apprehended by a resident and taken to the village head, before he was handed over to the police for investigation.
Tukur had since confessed to have committed the offences when interrogated by the Police.
The Appeal Court Judge Justice Abiru JCA dismissed the appeal, saying it lacks merit and affirmed the judgment of the trial court.
